OVERVIEW
Welcome to Yanara Elmina.
These Terms of Service (“Terms”) govern your use of the Yanara Elmina website and your purchase of products from us.
The terms “we”, “us” and “our” refer to Yanara Elmina. Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products to you.
Please read these Terms carefully before using our website or placing an order. By using our website or purchasing from us, you agree to these Terms together with our Privacy Policy and Returns & Refund Policy.
Nothing in these Terms affects your statutory rights under UK consumer law.
SECTION 1 — ELIGIBILITY AND ACCOUNT INFORMATION
You must be at least 18 years old, or otherwise legally capable of entering into a contract, to place an order with us.
When placing an order, you agree to provide accurate, current and complete information, including your name, email address, billing information and delivery address.
If you create an account, you are responsible for keeping your account credentials secure and for activity carried out through your account.
SECTION 2 — OUR PRODUCTS
We take reasonable care to ensure that product descriptions, photographs, measurements and other information displayed on our website are accurate.
However, colours may appear slightly different depending on your device, screen settings and lighting.
As many Yanara Elmina pieces feature handwoven and/or hand-painted elements, minor variations in weave, texture, colour placement and other handcrafted details may occur. These natural variations form part of the individual character of handcrafted pieces and are not necessarily defects.
This does not affect your statutory rights. Products supplied by us must be as described, of satisfactory quality and fit for purpose as required by applicable UK consumer law.
We may discontinue products or limit quantities available for purchase at any time. Any such change will not affect an order that we have already accepted.
SECTION 3 — ORDERS AND CONTRACT FORMATION
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing your order, you will receive an acknowledgement or confirmation by email. The point at which a binding contract is formed will be stated through our checkout and order-confirmation process.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there has been an obvious pricing or product-description error;
- payment cannot be authorised;
- we reasonably suspect fraud or unauthorised activity; or
- we are unable to deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the amount due to you.
Please check your order and delivery information carefully before submitting it.
Where available, we may provide a short self-service cancellation period for orders that have not yet been fulfilled. This does not affect any statutory cancellation or return rights you may have under UK consumer law.
Returns and cancellations after purchase are governed by our Returns & Refund Policy.
SECTION 4 — PRICES AND PAYMENT
All prices are displayed in Pounds Sterling (GBP).
The price payable is the price displayed when you place your order, subject to the correction of obvious pricing errors where permitted by law.
Delivery charges are additional unless expressly stated otherwise and will be clearly displayed or calculated before you complete your purchase.
We accept the payment methods displayed at checkout.
You confirm that you are authorised to use the payment method provided for your purchase.
We may change our prices at any time, but changes will not affect orders already accepted by us.
SECTION 5 — DELIVERY
We currently deliver to addresses within the United Kingdom only.
Available delivery methods, charges and estimated delivery times will be shown at checkout.
We will take reasonable steps to dispatch and deliver your order within the stated timeframe. Delivery estimates are estimates and may occasionally be affected by circumstances outside our reasonable control.
Unless a different delivery period has been agreed with you, goods must generally be delivered within the period required by applicable consumer law. UK distance-selling guidance states that goods must be delivered within 30 days unless another timeframe has been agreed.
We remain responsible for the goods until they are delivered to you or to a person identified by you to receive them, except where applicable law provides otherwise.
If your parcel is lost or damaged during delivery, please contact us at hello@yanaraelmina.com so that we can investigate and resolve the matter.
SECTION 6 — RETURNS, CANCELLATIONS AND REFUNDS
Your rights to cancel an online order, return products and receive refunds are explained in our Returns & Refund Policy, which forms part of these Terms.
For qualifying online purchases, UK consumers generally have 14 days after receiving their order to tell us that they wish to cancel, followed by a further 14 days to send the goods back after notifying us.
For change-of-mind returns, customers are responsible for return postage where stated in our Returns & Refund Policy and permitted by law.
Different rights apply where goods are faulty, damaged, not as described or otherwise fail to conform to the contract.
Nothing in these Terms or our Returns & Refund Policy limits your statutory rights.
SECTION 7 — INTELLECTUAL PROPERTY
The content of our website, including the Yanara Elmina name and branding, logos, photographs, product imagery, artwork, text, graphics and website content, is owned by us or used by us with permission and is protected by applicable intellectual-property laws.
You may use our website for your personal, non-commercial use.
You must not reproduce, copy, distribute, modify, publish, commercially exploit or use our protected content without our prior written permission, except where permitted by law.
Third-party names, trademarks and content remain the property of their respective owners.
SECTION 8 — THIRD-PARTY SERVICES AND LINKS
Our website may use or provide access to services operated by third parties, including payment providers, delivery services and other technology providers.
Where you choose to access an external third-party website, that website may be governed by its own terms and privacy practices.
Nothing in this section excludes responsibility that we are legally required to bear in connection with your purchase from Yanara Elmina.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Yanara Elmina's online store is powered by Shopify, which provides the technology used to operate our online store.
However, products purchased through our store are sold by Yanara Elmina, and your contract for the purchase of those products is with us.
Shopify is not the seller of Yanara Elmina products.
SECTION 10 — PRIVACY
We process personal information in accordance with our Privacy Policy.
Our store is hosted by Shopify and certain personal information may therefore be processed by Shopify and other service providers involved in operating our store, processing payments and fulfilling orders.

SECTION 11 — REVIEWS AND CUSTOMER CONTENT
If you voluntarily submit a product review, photograph, comment or other content to us or through our website, you confirm that you have the right to submit that content and that it does not infringe another person's rights or contain unlawful material.
Where you give us permission to publish content, you grant us the rights reasonably necessary to display, reproduce and use that content in connection with our website and business.
We may remove content that is unlawful, abusive, misleading, infringing or otherwise inappropriate.
SECTION 12 — ERRORS AND AVAILABILITY
We take reasonable care to ensure that information on our website is accurate.
Occasionally, errors may occur in product descriptions, prices, promotions, delivery information or availability.
We may correct errors when discovered. If an error affects an order you have already placed, we will contact you where appropriate and deal with the order fairly and in accordance with applicable law.

You must not use our website:

- any other liability that cannot lawfully be excluded or limited.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses caused by circumstances for which we are not legally responsible.
If you purchase products as a consumer, we are not responsible for business losses arising from your use of products purchased primarily for personal use.
SECTION 15 — SUSPENSION OR TERMINATION OF WEBSITE ACCESS
We may suspend or restrict your access to our website where reasonably necessary, including where we reasonably believe that the website is being misused, security is threatened or these Terms have been materially breached.
Termination or restriction of website access does not affect rights or obligations arising from orders already accepted, except where applicable law allows otherwise.
SECTION 16 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

If we delay or fail to enforce any provision of these Terms, this does not mean that we have waived our right to enforce that provision later.

We may transfer our rights or obligations where permitted by law, provided that doing so does not reduce your rights under these Terms or applicable consumer law.

These Terms and purchases made through our store are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also have rights under the mandatory laws applicable where you live.
Nothing in these Terms deprives you of any mandatory consumer protections or rights regarding where legal proceedings may be brought.

We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.
The version applicable to an order will generally be the version in force when the relevant contract is formed.
